Article 38i MiFIRPeriodic penalty payments
ESMA may impose daily periodic penalty payments on data reporting services providers and related persons to compel them to end a breach, supply information or submit to investigations or inspections, set at 3% of average daily turnover (2% of average daily income for natural persons) for up to six months.
